Crossborder insolvency and arbitration. Disputes involving Russian state-owned companies & Russian Tea Room

On April 11, 2018 ICC Russia in partnership with White & Case hold the event “Crossborder insolvency and arbitration. Disputes involving Russian state-owned companies & Russian Tea Room” as part of the Paris Arbitration Week.

(1)    The event will be opened by the seminar on the following topics:

Cross-border insolvency and arbitration

The panelists will consider the issues of cross-border insolvency in Russia relevant to the arbitration proceedings (depending on whether a Russian debtor is the claimant or the respondent). The discussion will focus on the effects of Russian insolvency on arbitrability of disputes and jurisdiction of the arbitral tribunal, capacity of the representatives of the insolvent debtor to act in arbitration, enforceability of arbitration clauses; powers of insolvency administrators to unilaterally terminate long-term agreements, enforcement of awards against a Russian insolvent debtors and potential claw-back actions.

Arbitrability of disputes involving state companies

Arbitrability of disputes involving Russian state companies is a hot topic in the Russian case law and will soon be considered by the Russian Constitutional Court. Under Russian law public disputes are not arbitrable and Russian courts tend to interpret this rule widely. The panelists will discuss the recent trends in the Russian legislation and case law concerning arbitrability of disputes involving state companies, and in particular criteria for a dispute to be qualified as a public one, and specific disputes which may be considered non-arbitrable, such as disputes out of public procurement, investment and concession and other agreements involving use of the public funds.

(2)    During the second part, which is held for the second year, called “Russian Tea Room” the guests will meet ICC Russia Arbitration Commission members and see a presentation of the Russian arbitrators’ roster. Tea Room will be followed by the tea samovar, pryaniks (gingerbread), pancakes, drinks and networking.
